First-Offense DUI in Florida

Under Florida law, a driver can be charged with DUI when he or she demonstrates impairment of the normal faculties or has a blood alcohol level of .08% or above.

If you have recently been pulled over by law enforcement for DUI and this is your first time, you are likely wondering about the potential penalties you could face.

The possible consequences for a first-offense standard DUI include:

  • A fine of up $5,000
  • Jail time up to five years
  • License suspension
  • Installation of an ignition interlock device
  • Vehicle impoundment

When an individual is charged with DUI, the penalties may be enhanced if he or she had a blood alcohol level above .15%, had a passenger in the car who was under the age of 18, or caused an accident that resulted in property damage or injuries. The duration and extent of the penalties will also increase for repeat offenders.

In addition to the consequences mentioned above, first-time DUI offenders will be placed on probation. While on probation, the individual will be required to complete at least 50 hours of community service work. In most circumstances, the combination of jail time and time on probation cannot exceed one year.

Ignition Interlock Device (IID) Program

An IID requires that you breathe into the mechanism on your vehicle without a trace of alcohol before it will start. Under Florida law, depending on how many DUI convictions you have received you may be required to install an IID into your vehicle for a period of time.

IID Sentencing

  • First Offense – 6 months (if your BAC level was 0.15% or more)
  • Second Offense – 1 year
  • Third Offense (and more) – 2 or more years

It is also important to note that It is up to the judge to decide if you will have one installed after your first offense if your BAC percentage was lower than 0.15%.
